A construction permit (yapı ruhsatı) is the mandatory municipal authorization that allows lawful construction on a parcel in Türkiye. It is governed by Zoning Law No. 3194; any building without one is classed as illegal (kaçak). This guide walks through every stage and the documents required.

What Is a Construction Permit?

The permit certifies that the project complies with the zoning plan, regulations and technical standards. Without it:

  • The building may face a demolition order
  • Owners receive zoning fines (per m²)
  • No occupancy permit (iskân) can be issued
  • Title cannot register condominium status
  • Banks will not extend a mortgage

The 7-Step Permit Process

1. Zoning Status Document (İmar Durumu)

Obtained from the municipality. Contains floor area ratio (KAKS), building footprint ratio (TAKS), setbacks, story count and use type.

2. Cadastral Layout and Topographic Survey

Prepared by a licensed surveyor.

3. Geotechnical Report

Geophysical and geotechnical surveys — mandatory under the earthquake regulation.

4. Architectural Project

Architectural, structural, mechanical and electrical drawings, all stamped by their respective professional chambers.

5. Municipal Review

All drawings submitted to the zoning department. Review typically takes 30–60 days.

6. Payment of Fees

  • Construction permit fee
  • Parking shortfall fee (if applicable)
  • Building inspection fee
  • SGK construction registration

7. Issuance of the Permit

Once approvals and payments are complete, the permit is issued.

FAQ

Is there an amnesty for unpermitted buildings?

Periodic zoning amnesties (Yapı Kayıt Belgesi) exist but do not replace iskân and may be ignored by banks and certain transactions.

Can I get a permit without an architect?

No. The architectural project must be signed by a chamber-registered architect. Same for structural (civil engineer), mechanical (mech. engineer), electrical (elec. engineer).

Do I need a permit for renovation?

Interior remodeling that doesn't touch the structure or façade doesn't require one. But unit reconfiguration, splitting/merging apartments, attic extensions need a renovation permit.
